Terms
This document is the official public offer of the limited liability company “Z Brothers Event”, hereinafter referred to as “ZB”, and contains all the essential conditions for the provision of services.
In accordance with Article 437, Clause 2 of the Civil Code of the Russian Federation, the legal or physical person making the acceptance of this offer becomes the customer in case of acceptance of the conditions and payment of services stipulated below.
In accordance with of article 438, Clause 3 of the Civil Code of the Russian Federation, the acceptance of the offer tantamount to the conclusion of the contract on the terms set out in the offer.
1. DEFINITIONS
1.1 The following terms in this public offer are used in the following meanings:
Acceptance of the offer-full and unconditional acceptance of the terms of the offer by means of actions by customers expressing their intention to use the services of ZB.
Customer- a legal or physical person submitting Order on the ZB website.
Order – service of transportation of passengers and baggage on the automobiles of “B” and “D” categories Ordered by the Customer at ZB web-site.
Executor – a carrier of ZB, which accepts the Order for execution.
ZB website – www.z-brothers.com
Rate – financial conditions for Customers, regulating financial relations between Customers and ZB.
2. SUBJECT OF THE OFFER
2.1 The subject of this offer is the provision of ZB services for the transportation of customers and baggage in category B and D vehicles (motor vehicles).
3. GENERAL RULES
3.1 Public offer is official document, which is published at website www.z-brothers.com. ZB has the right to change the terms of this public offer and additions to the public offer without prior agreement with the customers, ensuring the publication of the modified terms on the ZB website at least one day before their entry into effect.
3.2 ZB has the right to terminate the fulfillment of obligations under this Agreement unilaterally in case of violation by the Customer of the terms of this agreement.
4. RIGHTS AND OBLIGATIONS OF THE PARTIES
4.1 ZB shall:
4.1.1 Ensure the confidentiality of data transferred to the Executor.
4.1.2 Provide the Customer with vehicles not older than 3 years.
4.1.3 Provide work of ZB office ZB 24/7.
4.1.4 Take the Order at least 3 hours before the start of the trip (the Order for less time is possible if there are free cars).
4.2 ZB has the right:
4.2.1 Change the composition and technical characteristics of the services.
4.3 Customer shell:
4.3.1 Pay for ZB services, according to the rates.
4.3.2 Make an Order at least 3 hours before the start of the trip (the Order for less time is possible in the presence of free cars).
4.4 Customer has the right:
4.4.1 Pay for the Order by bankcards Amex, Visa, and Master card.
4.4.2 To cancel the Order not less than 12 hours, from the Order with the minibus-for 24 hours.
4.5. For the Customer it is prohibited:
4.5.1 to drink alcohol, use drugs, carry weapons, as well as explosive, flammable substances in motor vehicles. Transportation of small pets is possible by prior arrangement with the manager of ZB.
5. PAYMENT PROCEDURE AND FINANCIAL RELATIONSHIPS OF THE PARTIES
5.1 Payment by the Customer of ZB services is made by an advance payment in the amount of 100% of the price of the Order at the rates given on the ZB website.
5.1.1 In the section Rates, prices for standard Orders are given, not including large and / or special events. Prices are for information only.
5.1.2 The actual price of the Order may differ slightly due to currency exchange adjustments, changes in fuel prices, taxes, duties, inflation etc.
5.1.3 The final price of the Order must be specified before booking by phone + 74955405233 or by email: [email protected]
5.2 In some other countries, there is a surcharge for night fare. Surcharge information is available on request to [email protected], or by phone + 7 (495) 540 52 33.
5.3 A trip around the city is paid according to the hourly rate.
5.4 The prices confirmed by the manager are valid for 15 days.
5.5 Transaction fee is not included in the price of the Order.
5.6 At the end of the Order, an additional invoice may be issued for non-booked expenses.
5.7 When calculating the trip time, the service time is rounded up to half an hour.
5.8. The cost of services is calculated according to the number of hours worked with rounding up to half an hour according to the following rules:
From 0:00 to 12:30 – is considered as half an hour
From 0:00 to 12:31 – counted as an hour.
5.9 Meeting and seeing off at the railway station are paid as the hourly rent of the car.
5.10 Transfer to the airport includes 15 minutes of free passenger waiting; waiting for more than 15 minutes is paid at the hourly rate.
5.11 The price of the transfer includes a meeting of the client with a sign in the arrival hall and assistance with luggage.
5.12 The price of the transfer does not include paid parking and toll roads.
5.13 A trip or delivery of vehicles outside the city is paid additionally, price information is available on request.
5.14 The airport transfer includes an hour of free waiting from the moment of aircraft landing. Waiting at the airport for more than 1 hour from the moment of landing is paid according to the hour rate. All flights are tracked by ZB.
5.15 The price of the hour does not include parking, toll roads, and 20 km per hour over the limit.
6. RESPONSIBILITY OF THE PARTIES
6.1 At fulfillment of the Order, responsibility, including criminal, for life and safety of customers, their things, cargoes and animals carried by the executor at the time of fulfillment of this Order shall be borne by the Executor. The Order is considered to be executed after the Customer leaves the vehicle of the Executor.
6.2. If the Order is canceled within a shorter period than that specified in 4.4.2. of this Agreement, the Customer will be charged the cost of the minimum Order when traveling through the city and the cost of a transfer when traveling from / to the airport.
6.3. If the Order was not executed due to the customer’s fault the Order is considered fulfilled and paid at the rate.
6.4 ZB is not responsible for the things forgotten by the passenger in the car, information about forgotten things can be clarified by e-mail: [email protected], or by phone + 7 (495) 540 52 33
7. TERM OF THE AGREEMENT
7.1 The Agreement comes into force from the moment of its conclusion (acceptance of the offer), which is the ordering by the Customer and is considered to be concluded for an indefinite period.
7.2 This Agreement may be terminated or amended in the cases and in the manner provided by the legislation of the Russian Federation and the Agreement. In the event of termination of the Agreement, the Parties shall make mutual settlements for all obligations.
8. FORCE MAJEURE
8.1 The Parties shall be exempted from liability for partial or complete non-performance of obligations under this Agreement, if the failure was a consequence of force majeure circumstances that arose after the conclusion of the agreement. These include: war and military actions, uprisings, strikes, natural disasters, epidemics, explosions, fires, floods, decisions and orders of the legislature and their executives, influencing the fulfillment of obligations.
8.2 If a party invoking any of the circumstances of force majeure does not report the occurrence of force majeure within 3 (three) days, it may not refer to them, except in cases when the circumstance itself prevent the dispatch of such a communication.
8.3 The temporary absence of communication with the servers where the site ZB is located, is recognized as a force majeure event, but is not the reason for failure to fulfill its obligations by ZB on Orders accepted before the period of absence of communication.
9. OTHER CONDITIONS
9.1 In case of claims, the Parties will resolve them through negotiations. In case of failure to resolve the dispute in claim order, they are subject to review in the manner prescribed by the current legislation in the arbitration Court of Moscow.
9.2 ZB performs its duties under this agreement in person and, if necessary, has the right to attract third parties for the fulfillment of the terms of this Agreement.
